The Building Services Department has the responsibility of issuing building licences for all new developments, patios, garages, fences, swimming pools and isolation barriers, additions to existing dwellings and any other alterations to a property. The prime role is to control building works within the Shire.

The Building Services Department consists of the following staff and can be contact by phoning

Building Services is responsible for issuing the following licences, permits and carrying out inspections on behalf of the Shire of Wyndham East Kimberley.

  • Issuing of Certificate of Classification for Commercial Buildings (class 2-9)
  • Issuing of Storage of Materials on the Street Permits

 Please note that in most instances Planning approval is required for development

Building Licences

A planning or development approval may also be required prior to the issue of the building licences.

Licences & Applications

Unauthorised Works Legislation

 As a result of new legislation introduced, effective as of 1 July 2008, a new process is required in order to facilitate the authorisation of unapproved structures.

In accordance with section 374AA – “Building Approval Certificates for Unauthorised Work” Part XV of the Local Government (Miscellaneous Provisions) Act 1960 and Regulation 11A – “Application for Building Approval certificate” in the Building Regulations 1989 the check sheet relating to the application will need to be followed so the Shire can  allow the unauthorised building works to remain on site.

Swimming Pools

State Government statutes require Council to undertake at least one inspection within a four year period of all private swimming pools and spas in its area to ensure that suitable restrictive barriers are in place to prevent drownings.

The Shire’s Building Services Department must inspect the land and the swimming pool periodically so that a period of not more than 4 years elapses between inspections.

The Western Australian Government’s new 5 Star Plus standards commenced on 1 September 2007 as a result of these new standards all new swimming pools will require a pool cover to reduce evaporation.

These covers need to be accredited under the Smart approved Watermark Scheme governed by the Australian Water Association, the Irrigation Association of Australia, the Nursery and Garden Industry Australia and the Water Services Association of Australia

All private backyard swimming pools are required, by law, to be adequately isolated with a barrier, in order to prevent unsupervised entry of children. All gates providing access to such pools are required to be self-closing and self-locking, and the pool fence is to be a minimum height of 1.2 metres, unscalable barrier.

Regular inspections are carried out by the Shire to ensure the compliance of back yard pools with the relevant legislation. For information on all aspects of pool isolation barriers please contact Sharon McLachlan or Dan Cox at the Shire’s Building Services Department.

All pool fencing and gates must comply with A.S. 1926.1.

  • A building licence is required
  • An inspection fee of $55.00 over a 4 year period shall be charged  at  $13.75 per annum on the property rates notice.

Asbestos

Asbestos cement products were commonly used in buildings during the establishment of Wyndham and Kununurra and as a result, many buildings contain asbestos.

Asbestos is a hazardous material. It's removal and disposal is legislated by the Health (Asbestos) Regulations 1992 and Worksafe WA. Download an information sheet or contact Worksafe for further information.
